Last updated: August 28, 2026
These Terms of Use ("Terms") govern your access to and use of the Amest website, tools, reports, AI features, data, and related services (collectively, the "Service"), operated by Jasman Gill (operating as Amest) of Calgary, Alberta.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About Amest
Amest is a technology platform that provides property information and preliminary analysis to help you explore potential development scenarios in Calgary. Amest is not a municipality, government or planning authority, architecture, engineering, or surveying firm, law firm, real estate brokerage, appraiser, financial institution, or regulatory authority.
2. Eligibility
You must have the legal capacity to enter into these Terms. If you use Amest on behalf of an organization, you represent that you are authorized to bind it to these Terms.
3. Nature of the Service
Amest provides informational and decision-support tools. It may display information about properties, zoning, land use, development standards, building possibilities, costs, financial scenarios, and related matters. All of it is preliminary and informational only. Amest does not determine whether a project will receive municipal or regulatory approval.
4. Artificial Intelligence
Certain features use artificial intelligence and third-party AI technologies. AI-generated output can contain errors, including plausible-sounding but incorrect information. You agree not to treat AI-generated or AI-assisted output as authoritative professional or regulatory advice, and you are responsible for independently verifying material information before relying on it.
5. No Professional Advice
Amest does not provide legal, architectural, engineering, surveying, planning, appraisal, tax, accounting, investment, financial, construction, brokerage, or other professional advice. Nothing provided through Amest creates a professional, advisory, fiduciary, or agency relationship.
6. No Development Guarantee
A result generated by Amest does not constitute:
- zoning confirmation;
- a development permit, building permit, or subdivision approval;
- municipal or regulatory approval;
- an architectural or engineering opinion;
- a survey, real property report, or appraisal; or
- a guarantee of development potential, cost, or return.
You must independently confirm applicable requirements and approvals.
7. Your Responsibilities
You agree to:
- provide accurate information when using the Service;
- use the Service lawfully;
- independently verify material information and obtain professional advice when appropriate;
- confirm requirements with the relevant government authorities;
- protect your account credentials; and
- respect intellectual-property rights and not interfere with or attempt to compromise the Service.
You are solely responsible for decisions you make based on information from Amest.
8. Prohibited Uses
You may not:
- use the Service unlawfully or attempt to bypass security or access controls;
- interfere with the Service or introduce malicious code;
- scrape, harvest, or systematically extract Amest data except where expressly authorized;
- reverse engineer the Service except where that restriction is prohibited by law;
- use automated systems to overwhelm or abuse the Service;
- impersonate any person or organization, or use Amest to commit fraud or misrepresentation;
- resell Amest output or data except where expressly permitted; or
- use Amest's intellectual property to build a competing service where prohibited by law.
9. Accounts
You are responsible for the confidentiality and security of your credentials and for activity under your account. Notify us promptly if you believe your account has been compromised. We may suspend or terminate accounts where reasonably necessary to protect the Service, other users, or third parties, or where these Terms have been violated.
10. Subscriptions and Payment
Amest offers a paid subscription. Payments are processed by Stripe. Subscriptions renew automatically until cancelled; you can cancel at any time through the billing portal, and cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.
11. User-Provided Information
You represent that you have the right to submit any information, documents, images, plans, or addresses you provide to Amest. You grant Amest the limited rights reasonably necessary to process that information to provide, maintain, secure, and improve the Service, subject to our Privacy Policy.
12. Third-Party Information and Services
Amest incorporates and links to information and services from third parties, municipalities, government bodies, mapping and data providers, and AI providers. Amest does not control all third-party information and does not guarantee its accuracy, completeness, or availability. Third-party services may have their own terms.
13. Intellectual Property
The Amest name, branding, software, interfaces, designs, databases, methodologies, and original content are owned by Amest or its licensors and protected by intellectual-property law. Except as expressly permitted, no part of the Service may be copied, modified, distributed, sold, or commercially exploited without prior authorization.
14. Feedback
If you provide ideas, suggestions, or feedback about Amest, you authorize us to use it to improve the Service without obligation to compensate you.
15. Service Availability
We may modify, suspend, or discontinue any part of the Service. We do not guarantee uninterrupted or error-free availability.
16. No Warranty
The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. Amest does not warrant that information provided through the Service will be accurate, complete, current, error-free, suitable for a particular project, or accepted by any governmental or regulatory authority.
17. Limitation of Liability
To the fullest extent permitted by law, Amest and its owner, contractors, affiliates, licensors, data providers, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to use of the Service. This includes losses relating to property purchases or sales, construction or development decisions, permit applications, professional fees, financing, lost opportunities, lost profits, project delays, inaccurate data, AI errors, or reliance on Amest output. Nothing in these Terms excludes liability that cannot lawfully be excluded.
18. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Amest and its owner, contractors, and affiliates from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Service, your violation of these Terms, your infringement of third-party rights, or your misuse of Amest information.
19. Privacy
Our handling of personal information is described in the Amest Privacy Policy.
20. Changes to These Terms
We may update these Terms periodically. The current version will be posted here with its update date. Continued use after an update constitutes acceptance to the extent permitted by law. Where additional notice or consent is legally required, we will provide it.
21. Governing Law
Unless applicable law requires otherwise, these Terms are governed by the laws of Alberta, Canada and the applicable federal laws of Canada. Disputes are subject to the jurisdiction of the courts of Alberta, subject to any rights or remedies that cannot lawfully be waived.
22. Severability and Entire Agreement
If any provision of these Terms is unenforceable, the rest continue in effect. These Terms, together with the Privacy Policy and the Disclaimer, constitute the agreement governing your use of the Service.
